The core concern raised is that the proposed regulation of recoverable costs under Section 294 of the Planning and Development Act 2024, as set out in the consultant’s Scale of Fees report, risks making access to justice prohibitively expensive in practice. It would disproportionately burden volunteer-led community actors and deter lawful challenges that uphold environmental and planning standards.
